I sold my car to a friend and give the car to him even if it is not yet paid in full, he's still making payments on it, the problem is he stop making payments and the cars name is still under my name and the insurance too,which he was supposed to be paying monthly too.The car is still in his possession and I wanted to get the car back, I tried calling him and going to his house but he cannot be reached.I was planning to get the car towed from my insurance company, the problem is I do not know where to locate him, Can I report it to the police ,but I dont want to report it as stolen I just wanted my car back will they be able to help me to locate my car and not file it as stolen ,can they help me in towing it too. AnswerI doubt that the police will get involved as they will say it is a "civil matter". They might be there when you do "repo" it but that will be mainly to keep the peace...
If you are having trouble finding it and he is hiding then you will have a huge uphill battle I think...
One idea which might work, but will be costly is to contact a "REPO COMPANY" and see if they will help you. Other than that it most likely will be luck if you find it...
Since you are paying for the insurance well I personally would cancel the insurance as you are responsible for everything that happens.. If they wreck it you get to pay all the costs...
Reporting it stolen might be the best thing, if they will do that. But remember again you did give permission to drive it....
But more advise would be check with a lawyer and see what they suggest to "limit your exposure - risks"..
