Towing Issues: illegal towing, apartment manager, shared parking

My car was parked in the parking lot of the apartment complex I reside. My housing contract guarentees me one parking space, unassigned. I have lived here for a year and have never had problems with towing. This morning my car was towed by the owner of an adjacent building. I am assuming the parking lot is shared, but am unsure. She never posted signs in the parking area nearest her building stating no parking and there are currently none up. I took photos of the area for evidence. Should I have to pay the towing charges? What action should I take?

Ah, the wonderful shared parking lot issue.  What fun, WHAT NIGHTMARES.

Now I would check with your apartment manager and see what information they have for you, and if you can check with the other building manager if you can.

Now as to the "no signs" issue, I hate to say it but without a state and city listed, I can not point you towards laws covering this. In some areas this is a big violation of laws, and other areas then it is not a matter.

Pictures of everything are good, but remember that court cases love documentation of everything.
Keep good notes on all the information and talks you have. That will help determine what is able to be done.

As to paying the towing charges, well do you want the vehicle ?   You do know the fees (storage go up each day) so it gets more expensive each day.
Have you got the vehicle out yet?  I would of as soon as possible and then work on resolving the issues of why it was towed.

But defining the parking lot borders is something that you need to do or see if the managers can do soon. After all it can cause problems.  

One question I have here, have there been other vehicles towed before or is yours the only one been towed so far?
