Towing Issues: Towing abandoned car in Oregon, storage fees, brain teaser


Question
If the car was sold and the vehicle bill of sale was submitted to DMV and the car was flagged but the new owner failed to turn in the title transfer (I do have a copy of the title transfer with his signature and date) and the vehicle was towed, who would be responsible for towing and storage fees?  It seems if the original owner followed the law, he should not be penalized if the new owner shirked his responsibility.

Answer
Well the laws in Oregon do specify that the last registered and legal owner is responsible for towing and storage fees.  Now as you know when you sell the vehicle and submit papers to DMV then it releases the responsibility.
As to the new owner doing what he has to do legally is something what no one will ever know why they do or do not do things required by law  (man that is a brain teaser)

But I do believe if the tow company does contact you about a towed vehicle that you can send copies of the paperwork to they and that "SHOULD" help remove the responsibility from you.

Check with DMV and make sure that is how it works, after all the tow company might also be mistaken in what the laws are or how they are enforced.
