Towing Issues: who to sue, handicap spot, small claims court

in Texas i was not parked illegally I was were i was suppose to be the tow company said i was park in a handicap spot but there are no signs are poles keep in mined the complex manager also write a letter on my behalf stating that i was not park in  the wrong spot and that there are know signs are poles where i was towed from i was not on the lines are anything they just said i was parked in a tow zone forcing the handicap car to park in the loading zone and that is not true where i was parked is not a handycap spot and the car that was in the loading /handicap spot because that is where the sign is she is always parked in the same spot and i always for the last year until i was tow always parked in the same spot and the tow company has been towing cars from hear since i lived hear i had authorization to park were i was know one authorized the tow.i tow company broke an arrangement with the complex they were told were not to tow from but they did it anyway I need to know if i need to sue the complex and the tow company to get my money back and the money for my damages.The apartment tried getting my money and the tow company at first agreed and then at the last minute they backed out and said they wood see me in court so i sued in small claims court and they told me i sued the wrong party i also fill out the papers wrong  I put the storage company in both places on the form. when i was going to court the complex wrote a letter stating that i was not parked illegally and that the tow company did something they were told not to do in there contract. I have the letter still. I was previously advice that the only way to get my money back for the tow and also my damages is to sue both party the complex and the tow company. They said it was the complexes place to get my money back not mine since the tow company has a contract with the complex not me is this the only way because i do know that i have to live here another 10 months what should i do please advise if this is the only way on my receipt it does not even have why i was tow nor did they produce any pictures when i asked. they say i only have 14 days to sue tow company in Texas are i have to do a joint suit with the tow company and the complex the tow company damaged my car while towing it.i was advise to sue them jointly leaving know lose ends. the adviser said that since i had know contract with the tow company they could be acquitted from all accusations who is  responsible for my car and damages to it. the complex are the tow the ASAP

I hate to say it but in this case, you want to know who to sue...   Well the joke goes  "sue everyone, let the court sort it out"

As I am not a lawyer I can not tell you who to sue, but you should have an idea of who you can..   Apartment complex, Tow company, and then of course you were driving a vehicle. Heck sue the people that made it, sue the people that built the apartment complex, sue the State, the Federal government, the French, the Russians....  See you can list anyone you want but you will only get the people that are involved in the issue as the parties that be sued.

Sorry for taking to long to get to your question, but as a volunteer to this subject, it has to fit into my work schedule...  And it has been real busy for me towing trucks and buses.

That said,  in reading this one I hate to say this but it seems that the laws in Texas are a bit different regarding the taking tow companies to court..  30 days well if that is what the laws says then it is that way...

As to filling out the paper wrong that is bad as it ate up extra time..  

I am sorry that you did not get the justice you wanted but my best advise is to contact a lawyer and see what can be done.  Small claims court might be out but there are other venues available.

Sorry that you got towed and the vehicle damaged. It sounds like the apartment management did try to help you and get it back without you having to pay.
