Towing Issues: Illegal Tow?, mail phone, tow companies

My truck was towed from a parking space that borders my company's parking lot, after a 24 hour wait from the tow company.  The owner of the property claimed my truck was abandoned, although I begin work, and end work well before and after operating hours of the other business.  AZ law states a vehicle on private property must have evidence of no owner contact for 72 hours, and that the owner of the property must sign the tow bill.  Neither happened, and nobody attempted to make contact with me. What are my options?

Well I know that Arizona just revised some of the towing issues dealing with the proper licensing of tow companies and also the impounding of vehicles which are illegally parked or seem abandoned. This might be one of those things where it looked like a gray area on the tow authorization.

Property owners or managers are supposed to be on location when vehicles are towed to sign the authorization forms, but some cities have different laws regarding the use of " patrol towing" where the property owner has a signed authorization which authorizes towing without a manager or owner being present.
Now you stated it was towed from a parking space (lot) that is not your companies parking lot, which seems that you were basically "trespassing" on the lot. Not every vehicle has to sit for 72 hours, if they meet the requirements.
Some of them are lots are posted with signs stating who can park there or something like that, hours of enforcement  and such.

If it was posted properly (at one time, yes people do tear down signs to try to beat the law) then it might of been towed that way.

As to the law stating attempt to contact you, it is really hard for the general public to get vehicle owner information nowadays due to privacy laws. How would you like to be notified, mail, phone, note on the vehicle. Each of them have draw backs with the use of them...

But in most cases (and its not required in a lot of areas) a note on the vehicle stating it will be towed is notice. BUT courts have also ruled that with signs posted at the entrances to the parking lot and maybe throughout the lot(depends on size of lot) that it constitutes proper notification of the vehicle owner.

You can talk to the property owner about the issue, but most likely they will say that they did not know who to call and such. If you leave and come back when people are not there, it's real hard to prove the vehicle is moving and not abandoned.

If you still feel that you are not getting the satisfaction you want there is always the small claims court system.
