Towing Issues: Storage, abandonment, insurance co., storage fees, tow yard

Question
My truck was stolen and totaled then I retrieved it from tow yard as my
insurance company requested I do, but the insurance co. never paid it off and
have no intentions of doing so. The truck sits in my yard with no eng.  seats or
trans. Can I charge the insurance co. storage fees? Can I sell it?

Answer
well the best suggestion I have right now is LAWYER UP...

First of all, did you have the bare minimum insurance or was the vehicle fully insured.. That is a big key...  If it was not covered for theft and collision (and the like) then you the owner of the vehicle are responsible for towing and storage fees... But if it was fully covered then they should of been covering towing and storage fees...

A lot of insurance companies do everything they can to avoid paying on claims... They have about 39393829330 tricks to do this with...

From the sound of it though, I bet there was no coverage for the theft and recovery so it sounds like its all on you...

As to selling it, is it in your name still, or did you turn the title over to the insurance company when they paid for the loss... Big key in this answer also...

If you surrendered the title for a loss payout, then they are responsible, since they are the owners at that point.. If they did a payout and offered you a buy back on a recovery, then its your baby again...

Like I said at the start, contact a lawyer and see what they advise... While I answer questions here about towing issues I can not offer advise when I do not know the state or the full story... I only offer advise from practical experience of dealing with things like this all the time.
