Towing Issues: Another Tenant from my apratment complex had my car towed, podunk vermont, leasing office

I recently went out of town and I had parked in a "leased" car port that my apartment complex gave me.  When I returned home, my car had been towed.  When I asked the apartment complex if they had my car towed, they said that it would take about 2 weeks and they would have contacted me by letter and then a sticker on my car.  Come to find out, the parking spot that I had parked in, somebody else was given the same spot.  When I asked the apartment complex about what spot I was given when I decided to pay for an assigned parking spot, they told me that when I had signed my lease, they gave me a parking spot but to make sure that nobody was parking in it, if so they would have given me a different spot.  I, however do not remember this.  I checked the other spot that they had me assigned to, which was different from the first one, and somebody is already assigned to that spot.  I have two questions, (1) Can tenants of an apartment complex tow another tenants vehicle and (2) are tow companies allowed to tow from apartment complexes without having the leasing office's knowledge?

well to answer your questions first it would depend on the city and state you live in as there are different laws in different places. The laws in Fresno California are different then the ones in Podunk Vermont..

Now tenants calling for tows, it sometimes is allowed via agreements in rental agreements, property owner authorizations or other conditions, but it also does have HUGE POTENTIAL for problems. (Your stereo is to loud so the neighbor has your car towed, things like that)

Now the tow company can tow without the office knowledge depending on the terms of the contract they have with them...

But any towing company which removes vehicles does need a signed authorization to remove the vehicle...


This also does have a problem I see with the office not knowing what "ASSIGNED LEASED SPACES" are rented and used.. This is a big problem where they are responsible... If you rent a space you should be able to use it. They need to get the act together and get the paperwork correct. They can be held responsible when the paperwork says to use a space that you paid for and then are towed from because someone else paid for the same space...  

Talk to the property management and tell them to get it corrected and that you want to be paid back the fees you paid as it was what you paid for.
