Towing Issues: Homeowners Association towed my car!, towing company, homeowners association


Question
I was out on vacation for over a month. I was parked in my legal assigned spot.
The HOA towed my car as they were painting the parking lot. They say notices were issused that the lot has to be empty. but as I said I was out of town long before that.
In addition they didnt even call or email us - they have our contacts. Since I was out of town it cost me alot at the towing company.
DO i have a case? The HOA should show some responsibility of contacting before towing?

Well its hard to say that the HOA is responsible for not trying to contact you... Most people would argue that they should do more than just post notices..  But it gets real hard to try and find everyone's vehicle, figure out who they are and notify them.

But it also does have issues with being legal and also having the ability to do the jobs which they have contracted and are paying for...

As to the fees, I am sorry but that just is one thing that most people have to handle.  I do not think that you will find the HOA making the effort to be responsible for this, or paying part of the fee.  But you never know about this, they might surprise you and pay some of the fee.
