Towing Issues: private towing - HOA, current association, tow company


Question
The HOA I live in (Tucson, AZ) has signs posted regarding violators will be towed if parked in certain areas. Consistently there is an individual parked there even though they have been approached and asked not to do so in addition to the signs. Lately as soon as a phone call is made to the towing company to have the car removed, the person gets out of the house, and moves their car.
3 issues - 1), I think the tow company is tipping him off, is there anything that can be done except switch companies.
2) When calling around to other companies, was told that only rogue companies agree to tow off without owners approval. Where is this at?
3) If that is indeed the case, why in the world have rules at all and won't it be hard for businesses to tow people, too..not just the HOA?

well sounds strange there..

As to the towing company tipping off the person, why would someone who makes money from removing vehicles take and call people to move... Not sure there unless its a tow company person seeing someone there (he might even be the person that gets the call)

Now rouge towing is big problems and is fast losing its respect and legality ..  I would not consider that at all..

Now if the HOA does not want to enforce rules and regulations, then you are kind of out of luck. Nothing that can be done by you will help short of removing the current association members and starting over.
