Towing Issues: Towing from Apartment complex, tow company, reasonable person

I went to a local bar that is located in my apartment complex in The Colony, TX. I parked in a covered garage which stated as you entered "Reserved resident parking only - All others will be towed." No other signs posted anywhere inside the garage. Since I was a resident of said complex I thought nothing of it until I came out of the bar and my car was not there. Per the state I have 14 days to protest my towing in writing, do I have a case. Wouldn't a reasonable person believe if they were a resident of the complex they could park there.

Well, aahhhh  you are correct in thinking a reasonable person would assume that you are allowed to park there, but if you have a complex big enough to have a bar in the apartment complex then you have problems.  

First of all I would believe you as a resident have a covered space assigned to you. Correct ?

Is it marked or numbered ???  Is it your authorized parking space ?

You see where I am going ?

You parked in someone else's space even though you are a resident of the complex (do you have permits or stickers on the vehicles to show you live there ?)

Most likely what happened is that you parked in a persons space and they came back from where ever and wanted to park and then called the apartment complex management who called the tow company. End result you got towed.

As to the state law, sure you can protest the towing, but I honestly think you will not win.  

Sorry, but I think there needs to be more common sense here and you should check with the management about parking areas which you are allowed to use when in other areas of the complex.

Ok  I am lost here...  You have an attached garage where you park your vehicle..  That is your apartment - home.

The space you parked is not next to your apartment - home but somewhere else in the complex...

There are no permits,  that means its hard to say if you really live in the complex.  I think that might be a problem.

Best I can say is that you gather all the information you can, have pictures and copy of the lease agreement and any parking regulations which you have from the management.
