Towing Issues: private property towing issue, small claims court, property tax records

Hi Richard. Thank you for your answer from my past question on the private property issue at the fair. I have another question if I may ask. We do indeed know that the person who owns the property did have our car towed. The towing company told us that it was the owner that we saw at the lot who signed the papers, because they have towed other cars from that person in the past. We asked the towing company if they could give us the name of the person who signed the papers, but the towing company said they couldn’t give us that information. Is that true Richard?  We strongly feel that the owner of the property was in the "wrong" for what he did and we do want to take this to small claims court.

well I hate to say it but under the laws we have nowadays regarding privacy it might be correct and legal for the tow company to withhold the name. However there is always the local property tax records which you can go search and obtain the property owners name.

If you are going to go to small claims court, you can follow the deep pockets theory.  List everyone and let the courts decide who and how much is liable for each person.

Just remember while the property owner signed for the tow, and the towing company did the job it was asked for that the property owner is the bottom of the line there.
  As a tower I hate when we get involved in the private tow away business because we are always looked at as the ONLY ONE involved in the process.  That is usually because we took your money and have your vehicle.
