Towing Issues: Legal Tow, tow truck company, small claims court

I live in Fall River, MA. My guest was parked illegally,overnight, in my apartment community. The community had sent out a notice indicating that they would be towing cars that were illegally parked about a week before the even occured. They did not list the towing company name in the notice. When the car was missing in the morning, we called the police, but the tow company did not notify the police department that they had towed the car. The rental office was not open at that time, and none of the "on call" staff knew of the tow company. Three hours later, my guest finally got their car back. Is there any way to reclaim the cost of the tow or be compensated for the missing time from work? Is it legal for the tow truck company not to notify the police dept when they tow a car, even if it is from private property?

Well, hate to say it but I am going to start at the end of the question first.

Some areas require that the police be notified before towing, some require notification after the tow. And some do not even require notification of the police.

Getting the money back for the tow, come on you admitted that they were parked illegally.  I do not beleive that you can recover the costs of the tow, or for lost time from work. Sorry about that, but its one of lifes lessons...
But if you feel that you want to try, you can always try the small claims court route. Never know what will happen there.

As to the notice from the property management not listing the towing company. I think that might of been an honest mistake.
