Towing Issues: towing collections on credit report, better business bureau, tow operator


Question
IF I HAVE SOLD A CAR IN TRACY CALIFORNIA AND IT LATER GETS TOWED FROM NEW OWNER. I FILED A TRANSFER AT DMV BUT THEY SHOW NO RECORD OF IT.
IF I RESUBMIT THE TRANSFER PAPERS TODAY WITH THE
ORIGINAL DATE ON THEM, AND SHOW PROOF OF TRANSFER
TO THE TOWING COMPANY, DO THEY HAVE TO REMOVE IT FROM MY CREDIT REPORT EVENTHOUGH THE STAMPED RECEIPT DATE OF THE TRANSFER PAPERS SHOWS A DATE
AFTER THE DATE OF THE TOWING?

Doug,
If you can prove that you submitted release of liability & change of ownership documents to the D.M.V. prior to the vehicle being towed, then my guess is that the tow operator cannot legally report the charges as unpaid on your credit report. If I were you, I would notify the credit reporting bureaus that inaccurate information was used to report you as being delinquent. You may also choose to report the tow operator to the Better Business Bureau, and to any law enforcement agency you deem appropriate if they do not remove the information from your credit report and stop attempting to collect money from you that you do not owe due to the fact that you were no longer the owner of the vehicle when it was towed.
