Towing Issues: Daytona Beach Raceweek vehicles towed, bob evans restaurant, small claims court

Question
Bob Evans Restaurant towed my truck last week.  They were auctioning off their own parking spaces for $20.  My boyfriend parked the truck on the grass on the street beside bob evans along with other vehicles.  All vehicles were towed.  At no time were they blocking traffic.  I pulled the property appraiser information and Bob Evans property line is up to the trees which he was parked in front of. They tried to tell me that it was their private property but according to the records it is city (or county_ as it is close to the road.

$100 to get it out and last night on the news, there were other individuals this had happened to in daytona.

What can I do?  From what I see bob evans had no right to tow this and the towing company should have know better.  I can email a picture of the property appraiser shot and show where the truck was parked

Answer
well sending me pictures and such will do no good in solving this issue...

I know that race week (and bike week) are big problems down there, and as such lots of vehicles get towed, some legally and some illegally...

It would seem that ONE, the Bob Evans management does not know what or where their property line is, and TWO the tow company is following orders of the property management...

Best answer I can give is to go to small claims court with this information and let the judge decide what the outcome is...

Sorry for the real lack of an answer, but it looks like a legal definition - determination battle here.
