Towing Issues: tow truck liability, dodge ram 1500, tow truck company


Question
My husband's truck (2003 Dodge Ram 1500)was towed this past Sunday and on Wednesday he was traveling on a flat stretch of Hwy doing 70mph. The truck driver behind him said that it looked like the the entire drive shaft fell out of the bottom causing the truck to flip end over end several times, ripping the engine off, before landing upside down on a metal guard rail that went through the windshield and ripped off the cab of the truck and burst into flames.The seatbelt jammed and thank God my husband carries a pocket knife so he cut himself free. Emergency workers at the scene all refered to him as the survivor and said they had never seen anybody come away alive from something like that. Now after I could breath again I asked what could cause this and the other tow truck driver said that it was probably from being towed incorrectly. So my question after that "wordy" set up is " Do you believe the tow truck company should be liable?" Please know I have never sued anyone and I am very grateful he is alive but it could have gone the other way.

All I can say is wow.. Its great your husband is ok.

Now as to this, I feel there will have to be alot more answered about this before we can answer some basic questions..

What was the reason for the orginal tow... That and what was done to the vehicle..

This is important in alot of answers..   Driveshafts being able to come out and cause the vehicle to flip, is not unheard of.. Its just a very rare and very wild incident ..

I have an idea or 2 but until we can get a few more answers I am not going to say much here.  IT would be bad procedure to continue..
