Towing Issues: MASS TOWING LAWS?, small claims courts, state of massachussetts

Question
I just got towed from a private lot because my parking pass expired a few days ago. Where can I find the Massachusetts laws pertaining to the proper procedure for towing? My passenger car door was opened (why?) and the inside of the door is scratched and the rubber lining is messed up - there is even a small dent on the outside of the door (my car is TWO days old - it was in perfect condition). and they did not report the towing to the police until AFTER I reported it stolen. I paid and got my car out - is there anything I can do about the damages? I am so upset since it is a brand new car. Please help!

Answer
I am sorry for the delay, I was very busy this week at work.

I have done some basic research on Massachussetts laws, and drew a blank.. However the State of massachussetts is one where the public utility commission or something along that line regulates alot of towing issues there. That might be why I could not find much information..
The expired parking pass, is something that will be hard to fight though.

Now as to the car door... It sounds interesting to me.   As a standard practice, its frowned upon to enter any vehicle you are doing a tow away on.  The bag of diamonds (or cash) under the seat could of been stolen. That is why its frowned on..

Now it sounds as though something is wrong and I suggest that you talk to the tow company about the "potential damages" (this is CYA here ) They should address the issue but most likely not to your likings. Any action beyond that should be though the small claims courts.

I know how the new car deal is, and that counts big time on the condition of the vehicle...

Good luck and I hope I helped you
