Towing Issues: getting a car back i dont want??, state dmv, tow company

Question
I live in a apartment complexe and they has a towing company they deal with that towed my car but the thing is i don't really want the car back because it does not even run....can i get in trouble for not going to get the car, eventhough i really don't want it anyways???

Answer
The answer to you question is the standard lawyer reply:  It depends.

It depends on what your state DMV laws say.  In California, if an owner does not pick up his car, the tow company may place a lien on the vehicle, and sell it at public auction.  If the amount received at the auction does not pay the entire bill, the tow company has the right to demand payment of the balance from the old owner.  They would have the right to a civil action to recover their losses.

Check with the tow company, and ask what their policy is.  You may find it is cheaper for you to get it out earlier than the auction, avoiding payment of storage fees, then to you could donate the car to a charity to get rid of it.

Good luck.
