Ford: 99 F-350 Powerstroke, magnuson moss act, trans fluid

I have an early 99 SuperDuty truck.  I bought it used from a used car dealer a few months ago.  One of the stipulations upon purchase was that they flush the tranny.  I beleive they put in the wrong fluid (Mercon) instead of (Mercon V), I cannot prove this since it doesn't say what oil they put in on the ticket.  A few weeks later, the truck began to shutter.  It started off very gradually and they became quite bad.  I had the fluid flushed again with the proper fluid for certain.  There was a slight improvement.  My T/C finally crapped out the other day.  I was wondering if there is any remedy under the Magnuson-Moss act for this truck with only 82k on it either from Ford or the dealership?  Do you have any knowledge of these things?  Anything information would be appreciated.

Damon if you have any of the  old  trans fluid and the shop that replace the fluid will send it out to have it tested if not .there is nothing you can do.this is a hard thing to prove .the onyl other thing is go back to whoever did the fluid change and tell them and see if they will split the cost. were are you located?
