Driving & Driving Test Tips: Passing through left turn lane, oncoming traffic lane, left turn

I was in an accident where the driver ahead of me on a 2 lane road (one lane going each direction with a left turn lane at the intersection) waved me to pass him up on the left through the left turn lane. As I passed the driver, he struck me with his car, and I hit a car in the oncoming traffic lane. Whose fault is it? His,  because he waved me through, or mine, because I passed on left through left-turn lane? Thanks.

You should never pass going through a left turn lane under normal driving circumstances, but look into this a little further to make sure this was not a set up.  I mean what was the car in ahead of you doing.  Was he stopped or just going slow or waiting you make a right turn?
