Driving & Driving Test Tips: whos at fault?, civil court, cars

Question
While driving, if I go over the solid white line because
traffic is stopped to go around them on the no parking lane
and get side swiped by a car(that was 5 cars ahead of me)
trying to do the same thing I'm doing.

This would be a close call, in that; you may pass a (one) stopped vehicle to proceed but you are not supposed to continue down the line in this area, but the other person should also have looked before turning into the area to pass also.  He would probably be more at faoult but in civil court it is not all or none but a percentage.  I would judge 60% in your favor but 40% in the other person's favor.
