Driving & Driving Test Tips: Auto/ motorcycle accident, dodge ram 1500, arc network

Question

Truck/Motorcycle Accid
I was involved in an accident where a motorcylce struck the rear, passenger side, wheel area of my dodge ram 1500 quad cab truck.  The impact snapped my wheel off at the axel and sent the motorcyclist, motorcycle, and wheel about 15 feet into the air with the bike and rider landing about 10-15 ft. behind my truck and my wheel landing on the driver's side of the truck. My truck shifted about 5 feet to the left on impact.  I was making a left turn and there were no bikes, then as I almost completed my turn I saw the rider thru the rear passenger window after my son yelled "ooh"  I am being charged with failure to yeild the right of way.  Witnesses stated that the motorcycle was moving at a high rate of speed - about 85-90 mph in a 45mph.  The police took no measurements or pictures of the scene although the rider was life flighted to a nearby hospital(he is okay-just bumps and bruises, with no helmet on - he was lucky) Who is at fault?

Answer
This will have to be analyzed by a reconstructionist.  You should go to the ARC network (online at www.accidentreconstruction.com) and find an expert in your area to handle this investigation.  It could go either way depending upon the speed of the motorcycle, the visibility at the location and your turning movement (i.e. a time distance analyses).

This is much too complex for a casual analysis via this venue.

Good luck.
