Driving & Driving Test Tips: Auto accident, dangerous intersection, mr winter

Mr. Winter. Today my fiance got into an accident where she was not at fault and neither was the driver that hit her. What happened was the light was malfunctioning so it was flashing red. Her and another car next to her stopped and waited their turn to proceed straight. At this same time there was a city worker working on the lights. As my fiance and the other car began to cross the intersection the city worker flipped the lights to solid green for the cars coming from the other direction. This proceeded in my car being hit and my car hitting the car next to it. The cops said that no one was at fault. Do we have a case against the city? There were no police at the intersection monitoring the situation. It is the most dangerous intersection in my area, and 15-20 accidents happen at this intersection every year. The city must be liable for improperly fixing the traffic lights. Am I right?

Someone should have been in the intersection to stop all vehicles, then have the lights turned back on, make sure that they were cycling and then let traffic proceed.
