Question
I was in an accident on the 40 Highway outside of Needles, CA. A flash storm came in so fast I had zero visability within seconds. I slowed and pulled over to the right sholder. My driver side rear was still partially in the slow lane. I couldn't see if there was a drop off on the right so I was afraid to go further. A semi truck in front of me started backing up, jacknifed and his back passenger driver tire on the tractor rammed by driver front side and rolled up on my hood. He told the CHP I hit him.
Will my EDR give me any info that will prove I was stopped at the time he backed into me? I have (had) a 4 month old 2006 Mercedes Benz E350.

No I don't think the CDR will have been active since there was no slowing by your vehicle that would have awakened it to start recording, but, if the semi drove up onto your hood, there is no way that he could claim you hit him.  A passenger car can not push a semi trailer up so that it would end up on the hood of your car.  It could only happen if he was moving onto your car.
