Driving & Driving Test Tips: Car Accident, vw jetta, stick to your guns

Question
I was hit in car accident by someone in a pick up truck who "did not see" me (as acknowledge by himself). I was going straight at about 25 mph, he turned left in front of and into me and hit my car in the front, mostly in the left front corner.
I had hit the brakes and there is one skid mark of about 8 ft from my car (this was a "T" intersection, we were in opposite directions when it happened).
my car (1985 vw jetta) is badly damaged and my girlfriend and I are receiving medical attention after this.
The other party's insurance adjuster said that they will probably get me partially at fault for speeding. I was not.
My question is: Do they have a case? or are they just being pretentious as usual?

Answer
From what you sent me, this is clearly a violation of 21801(a) Ca Veh Code.

If there is no evidence of you "speeding", in relationship to the collision, the adjuster is trying to intimidate you to lessen their liability.

Stick to your guns.  The other party's insurance company will have to pay full restitution for your damages and medical treatment.  In addition you should also ask for monies for the pain and suffering from your injuries and medical treatment.

If the insurance company does not want to play ball, get an attorney, and sue the insurance company.
