Tips on Buying Cars: Private Party Contract, filing bankruptcy, private party

Question
Hello,
In 2008 i bought a car from a private party.  We had a contract that seemed to be set up just as if i had bought
from a dealership. I paid a down payment and monthly payments on time every month. For some reason the title has yet to put into my name and the owner is now filing bankruptcy and is trying to get the car back to submit to the IRS. I wonder what i can do to keep this car. Is it legal for him to do this? Would have no problem faxing or writing out the contract for you if it'll help.

Thanks in advance!!

Answer
Juanita,

This is HIGHLY ILLEGAL!  You need to contact an attorney NOW!  Your seller has broken so many laws it isn't even funny!  Furthermore, you should be the registered owner of that vehicle, if you have been making payments and have a copy of the contract.  If that person is not a licensed dealer then he has broken the law and is liable for every penny you have paid him, plus all of the registration fees.  You will not be in trouble, but your seller will be.

Hope this somewhat helps.

Thanks - JB
