Tips on Buying Cars: Carfax was not correct when I purchased vehicle!, carfax report, tort case

Question
I bought a Certified Pre-Owned Mercedes. Carfax report was shown and given to me at the time. I was assured it was a clean vehicle. Well, I went to trade it in and a different MB dealership ran the Carfax. Said it was in a accident...did I know. ABSOLUTELY NOT!
I would NEVER have bought this car had it been.
The accident was 8/5/2006. I bought the car 5/27/2007. I was told that was plenty of time for it to have been reported and on the Carfax report.
Now, the Carfax from when I bought the car has a blank space compared to the one I received today. I thought that was rather odd.
The value of my car has now gone down. So I will have more trouble getting what i would like to for it.
I find this the dealership I bought its from fault and want it taken care of. Its a weekend, no one there to deal with this issue.
I was under the impression that a Certified Pre-Owned (especially from Mercedes Benz) could not be sold with a accident on it.
Nevermind that I feel they somehow lied on/about the accident. It is almost like the Carfax was altered...but I know it would take someone from the company or some expert to know that for sure.
What do you know about a situation like this?
Thanks

Answer
Never heard that one before.. but it sounds fishy to me.

I would take a printout of the "real" carfax straight to the dealership that sold you the car.. and demand an explination.. If somehow they altered the document - you have a legal tort case which could very well result in a nice settlement for you (given you can afford to take them to court) - although - you have to be careful, since I'm sure they have some little disclaimer in fine print saying "we are not liable for typed  or written errors in [Instert document]".. but even so - if they told you it had a clean carfax and it doesn't - I would go straight there the first chance i got... In all actuality - they owe you... the amount you paid for the car which was over the value of a wrecked one.. AND the amount to cover the added depreciation now that you wish to sell..

See what the dealership says... call a lawyer.. and call carfax (you should be able to verify their records with an actual person... they could probably tell you exactly when that accident was recorded in their database)

Really bad situation you are in.. but I hope you get them if they are in fact guilty of what it looks like they did... If you find out error in their actions and can't afford a good lawyer - call the BBB (better business bureau) in your state.. they can actually take them to court on your behalf...

Good luck Erin.. I hope you get it resolved..
