Used Cars: New to me DMV trouble, private seller, car title


Question
I just bought a car from a private seller but when i went to the DMV to register it to my name it turned out that the seller had also just bought the car and had not yet put it in their name so their signature on the car title was wrong so they gave me a statement of error or erasure form for the seller to fill out but they dont know what to write on it. what should they write on the form so i can transfer the car to my name?

It just needs to state that the party listed as the "buyer" has no interest in the vehicle and that the correct buyer is you. This is the case if you bought it from the person listed on the title as the owner.  If the person you bought it from never put it in their name that means they never paid tax on the car and are not allowed to sell it because they don't legally own it. That is called "Title Jumping" and is illegal in all states. If that is what happened the best thing for you to do is contact the person listed on the title(the typed name at the top) and see if they will fill out the statement listing you as the buyer. It is fixable but will take a little effort on your part. Let me know if you have any other questions or if this confuses you.
