Used Cars: Used car deal with false information., certified pre owned bmw, pre owned bmw

Question
About a week ago I bought a used car from a dealer the dealer handed me a car fax for the car I was interested in.  The car fax stated that the car was a "Certified Pre-Owned BMW" meaning it came with an extended 6 year / 100,000 mile warranty from bmw.  Because of this information I bought the car.  Before signing anything I asked the sales person if they would repair some of the interior issues (Dents in the dash, scuffs, scrapes, etc..) He not only said he would but also wrote on the bill of sale that he would repair the interior and then initialed it.  Needless to say the car was not a Certified Pre-Owned vehicle (Carfax's information was incorrect) and the manager said he would not honor the salesmans note and repair the interior when I brought the car in today.  Do I have a case for atleast small claims for anything?  Thank you.

Answer
Hi Shawn, Happy Holidays to you.

Personally I would go all the way with this one if all obligations written on contract are not fulfilled. Phone and make contact with the next level up. the GM or dealer principal, be blunt and explain obligations on your part written on bill of sale are not honored by your used car manager " if the conversation or answer turns negative " be polite and end it with, see your dealership in court.
Shawn,,, if it reaches this stage, let me know, and make sure you check the " make private box ".

PS,,, either way I would appreciate the outcome ?
