Used Cars: unsafe vehicle sold to my wiife, certified mail, florida dmv

My wife had bought a truck at a local used dealer called mutts motors in fernandiina  beach florida. But turns out the vehicle isn't even street legal. It has no turn signals  and any other numerous problems.  He had stated  he would fix these issues and pay for the repairs. But never followed through with his promise and told her he changed his mind. So I put a stop payment on tthe check for the vehicle and she returned it. Now he's trying to tell her he's going to take her to court for the money. I'm pretty sure as a dealer he can't sell an unsafe vehicle. Any help you can give would be great.

I don't have a lot of time but the short answer is that even in the Florida a licensed auto dealer cannot sell a vehicle (unless he specifically sells it as "PARTS AND SALVAGE ONLY" that is not roadworthy or that does not have the necessary equipment required by state law for operation on public roads. You did exactly the right thing and under no circumstances allow the dealer to have the vehicle driven or towed over to your property and dropped. (I have heard of this happening in Florida) I would send the dealer a response (email and regular certified mail RRR) telling him that he breached the agreement for the purchase of the vehicle and you hav no interest in doing any further business with him and to please not contact you again. I would also tell him that should he choose to force this issue into court that you will take that opportunity to move forward t seek compensation for your damages and filing complaints with the State of Florida DMV and Attorney General as well as posting your experince on "Rip Off Report" where it cannot be removed.

DONOT UNDERESTIMATE THE POWER OF YOUR STATE DMV! The Attorney Generals of tate write letters and the DMV's can immediately levy draconian fines and take away dealer licenses and put unscrupulous dealers out of business. You may want to file a complaint with the FDMV anyway.
