Used Cars: Bought Used Commander from dealer...did not disclose accident history, triple damages, jeep commander

My Fiance purchased a 2006 Jeep Commander. The Dealership was selling it under current existing warranty, and also sold her on an extended warranty. Before She took delivery of the car, I asked for a carfax report. The salesman said he can get that. I also gave her a list of "problems" I had found on Edmundds and the salesman said there were no "service Bulletins" for this vehicle. After driving the car home, she found "wind" comming through the winshield(problem listed on Edmunds which there is a service bulletin) and when further research was done, I carfaxed the vehicle and found it had been in an accident. This was never disclosed to us. It has been three weeks since she picked up the vehicle what can we do?

Sorry it has taking so long to answer, I live in Galveston/Houston.
The dealership cannot sell an extended warranty for a vehicle unless it goes through a inspection required by the warranty company. If a vehicle is properly inspected it will be noted that there has been an accident. Here's were the laws get tricky, the dealer can sell a vehicle that's been in a previous wreck as long as the did not do the bodywork, they can turn a blind eye and deny that they knew. The salesman saying he could not give you a carfax report means he probably knew about the damage, that's typical. You should of stopped at that time. If at anytime you asked anyone involved in the transaction if the vehicle had been in a wreck and they denied it, you have something. Does that dealer have access to carfax? There is a law called triple damages, if a dealer is deceptive they can be sued up to three times the value of what you paid for the vehicle. This would take an attorney. If you want to solve it, you need to find out who is the General Mgr and who owns the dealer. Do not talk with anybody lower than those positions, everybody below them will blow smoke, they do not want their commissions adjusted. I would ask to be let out and all monies returned. This is such a grey area because most consumers don't stand up. You can also contact the BBB and call your local DA office. From what I can tell the dealer is in the wrong and you should be able to get out. Google your city where you live and dept of Trans, it should come up as a .org sight and it will tell you the law's in your city.
