Used Cars: used car problem, small claims court, party transaction

Question
my mother bought a used car from an individual, he assured her the car was in good shape. 2 days later the car tore up.She was told it needed a new motor. She was also told that someone had recently worked on the motor and nothing was hooked up like it should be. The man doesnt want to give her her money back, would she have a case that you think she might could win

Answer
Generally a private party transaction is as/is, but if your mother could prove that the engine damage was fraudulently concealed you could have a case. Maybe he would take it back if you let him keep $200, and he gave you the rest of the money back. Offer him that option, and if that doesn't work threaten to take him to small claims court.
