Trucking: satellite and hos, hr break, sleeper berth

My company has satellites in all the trucks and a new program has been added, my question that no one can answer is, If I am on my 10 hr break,and I send or receive any message from or to dispatch without moving the truck does this require driver to log on duty while I am in sleeper berth. They want hos sent in while we are on break and I was told do not send anything in while on 10 hrs in sleeper.

That's an interesting question Martha.  I suppose someone could interpret that if you send or receive a message you are technically in service but I think that is a stretch.  It's no different than calling in to find out where your next load is when you come back on duty.  It's just another form of communication like email or text message.  If your company is auditing your logs be sure to check with them for their interpretation but I think you are safe.
