Trucking: bol law regarding payment, warehouse operator, luck jim


Question
We did some cross dock work for a broker who is now defunct, one of the carriers who picked up here is
 suing  us for $2500 and they acknowledge that we are not the shipper. What part of the bol law says that a warehouse is responsible I thought section 7 said it can go back to the shipper. They took us to small claims and the judge acknowledged that we are not the true shipper but still ruled in their favor. I want to appeal it but If I do so it will go to superior court.  Can you advise me on what law to look up that says they must go back to the true shipper. Or any other advice you have.  Should I get a local attorney to represent me since it is superior court.

I would suggest contacting a transportation attorney.  There are several variables.  Was the carrier acting as a common carrier or a contract carrier?  Were you shown as the shipper on the BOL?  or were you merely an agent of the broker or the shipper?  Are you also a broker or a carrier?  where you acting in the capacity of a carrier when you performed the cross dock service? or as a warehouse operator?  Were there any contracts or agreements other than a BOL?  This is a complex situation taht requires a knowledge of transportation law so I wouldn't just contact a local attorney.  Find one that specializes in transportation law.  Best of luck.  Jim
