Auto Insurance Claims: I was uninsured but i was not at fault, claims advice, accident liability

Question
I was in a car wreck and didnt have car insurance but the other party was at fault. He ran the red light which caused me to hit him. We both was given a ticket because we both saiad that our light was green. We haven't went to court yet and Now his insurance company is putting me in collections. What can i do about this? I live in Tennessee.

Answer
 Hello Tiffany,

How can you both receive a ticket?  If a police officer is not a witness and cannot substantiate with evidence who actually ran the light, he should not be writing a ticket to anyone.

You say the other insurance company has you in collections.  I'm not sure what you mean by that.  Do you mean they have paid a claim for their insured and they are trying to recover that money from you?  Why should you pay anything if both of you received a ticket?  Were both tickets for running a red light?

In view of the circumstances, I would strongly suggest you not pay the ticket because that is an admission of guilt.  I am assuming the ticket places you at least partially at fault for the accident.  I think your best course is to find a "ticket attorney". They specialize in negotiating people out of tickets.  Since you have so much riding on that ticket, defeating it is important. Probably the best way is to demonstrate that (apparently) both of you were charged for the same thing.  But that would be up to the attorney.

If I've missed something from your description, send me a follow up.

Good luck.
