Auto Insurance Claims: Auto Accident, residential street, liability insurance

I was driving down a residential street and when I turned right to enter my aunt's driveway, a woman in another vehicle attempted to pass me on the right side and hit my car, causing considerable damage to the right front wheel and front end.  She had no insurance and a suspended license.  I only had liability insurance on my vehicle.  I'll more than likely have to fix my car out of my own pocket.  The police officer told me I had to sue the woman.  Can you advise me on what I should do?

Hi Raymond,

It sounds like you already know what to do. Since there is no insurance you will have to pay for the repairs yourself. Then if you want to you can sue the woman that damaged your car. However, since she had no insurance and a suspended license, she likely has no money for you to get. You may win your car and be left with a judgement that you can not collect.
