Auto Insurance Claims: Insurance Settlement, claims advice, claim help

Question
My question is this, my 12 yr old daughter was in a car accident back in July with my ex mother-in-law.  There was no police report filed at the seen and unfortunately I was not present when they released my daughter from the care of the ambulance.  Approximately, 4 to 5 days after the accident, my daycare provider took my daughter to the ER due to she had been complaining of headaches, nausea, forgetfulness, dizziness for the past 4 to 5 days following the accident.  At first, I monitored her to make sure she was getting better but, instead she was getting worse.  The doctor ordered a CT scan, which we did and it stated she was fine. The insurance company has stated they will pay the bills, 7 months later and she is still continuing to have these issues. Her family doctor has stated it could take up to a year for her minor concussion to heal.  The insurance adjuster has only offered $500 for settlement of her claim.  My question is this, do I settle for this amount or what is the norm for this type of claim?

Thank you for taking the time to answer my question.

Answer
Hello Kim,

$500? Absolutely not. And whatever you do, do not sign a release. That's where this is headed.

My suggestion - you need a personal injury attorney who is skilled in insurance matters.  With offers this questionable, only an attorney can achieve a fair settlement.

Of course, the attorney will receive a percentage of the settlement, but it appears necessary in your case.

Understand that attorneys take "contingency fees" in these types of cases which means that they do not get paid until you get paid.  I suggest you search online for personal injury attorneys in your area.  Then check with the Bar website for their history and qualifications.  Or, alternatively, you can contact the bar directly and request a referral.  Most provide this service.

But by all means, seek legal help.

I wish you and your daughter well.
