Auto Insurance Claims: No fault insurance claim rights, 4x4 truck, fault insurance


Question
I was involved in a non injury crash, and not at fault, here are a cpl
questions I have

1. I drive a F-250 4X4, and its in the middle of hunting season and I
need a 4x4 truck, not a rental car, what rights do I have in regards to
what vehicle I'm given while the truck is being repaired?

2. The truck doesn't have bondo on it and I don't want any now, do I
have the right to require them to cut out the bent corner of the cab and
refuse to allow them to use bondo?

Answer
1.  you are entitled to a rental that meets your needs, but not your preferences.  If you need a 4x4 to complete your activities, this should be provided.  But you can't say you want a particular model or make.

2. you may have a misunderstanding of bondo.  Current repair technology is pretty impressive and filler can provide stronger material than the original.  But it cannot be used on all repairs.  The shop can tell you if it is appropriate for this repair.  The insurer will follow industry standards.  You can refuse them, but you'll have to pay the difference if it is not necessary.
