Auto Insurance Claims: whos liability??, whos liability??

Question
My car was left at a dealership for repairs and servicing.  I received a call next day that my car received damages from an unexpected golf ball size hail storm.  They are claiming "act of mother-nature" so I'm responsible.  Are they correct?

Answer
Hello Chae

I don't believe they are correct. They took the vehicle. When they take a vehicle they also take the risk. The act happened while they have the risk.

Also, the law of bailments seems to protect you there. The damage was not only because of an act of nature, but because of their negligence on keeping your car indoor while in their care.

Talk to a lawyer.

Good Luck
