Auto Insurance Claims: requesting settlement for pain and suffering only in calif., injury claim, pain and suffering

A little over a year ago (08)my finance and I were stopped at a light and a cell phone driver in a S U V  hit us from behind. Needless to say, OUCH! I am disabled now( I was the passenger and they were underinsured) NEW YEAR DAY we took a short put into town to pick up my christmas jacket and the next thing I recall I was being ambulanced to the hospital. This time an unlicenced with no proof of anything,their vehical was impounded snd its been over three months and we barely got farmers to cut a check for the bike this month. I am mentally and physicaly unable to argue with their adjuster for my injuries. QUESTION! What do I claim from their insurance when they will not release their coverage? Can I just ask for emotional and mental stress ? if so How? There is so much more I dont know were to begin

   I rarely do this, but I am gonna suggest you call our office.  I really cannot answer your question with the information you have provided me, and it will take much less time to just speak with you about your case.

   You first need to know for sure whether the negligent party has insurance or not, and how much.  You don't even seem to know that.  Second, you indicate you are disabled, but you don't indicate whether it was from the accident or not, did you have a subsequent accident?  Also, I notice you used the word "bike", were you on a motorcycle when you were rearended?
