Auto Insurance Claims: stolen vehical hit and run, small claims court, collision coverage

Hello, I'm was in a hit and run with a stolen vehicle. The vehicle went into my lane and side swiped me. I don't have collision so I'm being told the other insurance company will not pay and mine will not pay either. I do have comprehensive though, what are my chances of arguing that the person that hit me was intending to do it and therefore it would be considered as vandalism?

It is unusual to have no collision coverage, but to have comprehensive coverage.
