Auto Insurance Claims: Statue of Limitations on small claims court claim, auto insurance carrier, claims affidavit

Question
Good Afternoon.
In Michigan, what is the statue of limitations for filing a small claims affidavit on benefits for reimbursement?  I have been trying for over 2 years now to get reimbursed from the auto insurance carrier for bills I have paid.  One is from 1/14/09 and is probably the largest.
Also, how do I deem the correct district to file?  Where I live or where the accident occurred?
Thank  you for your help!

Answer
Hi Carrie,

The questions you are asking are legal questions and not insurance questions. I am not an attorney so my answers should not be considered legal advise.

As best as I can find the statute of limitations for injuries in Michigan is 3 years from the date of the injury.

In your case you should speak to an attorney. Where you would file the law suit will depend on if you are dealing with your own insurance company or another at-fault party. If it is another at-fault party you may need to file in the county where the actual driver resides. There are many question that need to be answered before all of those determinations can be made.

I hope this helps
