Auto Insurance Claims: Auto Accident settlement, usaa insurance, demand letter

I was in a car wreck on September 2.  I was hurt but not hospitalized.  Guy ran the red light and plowed into me and totaled my car.  I got the check for my car within 7 days.  We both have USAA insurance.  The claims dept. is awful as I've had to pay my co-pays along the way and the one I didn't went 90 days and still not paid so I paid it. I'm out $170 out of my pocket.  I have one more Dr's appointment and then I should be done.  How do I get them to be timely in making me an offer?  Do I need to send them a demand letter?

Yes, you need to send them a demand letter and list all your claims including your out of pocket costs and your injuries (if you're planning on claiming them).

If you're going to claim injuries (which it seems like you should) then I would suggest retaining an attorney to handle your case.  I think a bodily injury claim should almost always be handled by an attorney due to the complexity of the claim and the sophistication of the insurance companies in denying these types of claims.
