Auto Insurance Claims: Total loss, insurance company, frustration

Question
How can I get the insurance company (not mine) to give me the full amount I owe when I am upside down in payments? The other driver was at fault and his insurance has offered me less than I owe. Thank you, Dan

Answer
Unfortunately, the amount they owe you is the "actual cash value" when the vehicle was damaged.  The amount of your loan is not relevant.  This is the law in every state in America.  I understand your frustration, but they will not pay more than the law requires.
