Auto Insurance Claims: Hit on vacation and somehow, getting the shortend of the stick, Hit on vacation and somehow, getting the shortend of the stick
A 2002 Chevy Caviler
I was out of state and was hit. My car was totaled and the kid that hit me took full responsibility. It seems to me that I lose a car and he gets away with it. The total amount that I'm getting back is not enough to buy a car with the same value of my car, or even close. Plus, I am 6.5 hours away from my car and somehow, I have to get back there and get the things OUT of my car.. without having a car. This is really inconveniencing me and the kid that caused it, is worry free. How is this fair? Honestly, I am so mad about this whole situation. I feel that HE/or his insurance should pay me the value of my car BEFORE the accident. What should I do?

I am sorry to hear about your situation. I understand your frustration. You have your life majorly disrupted and the person who caused it is free of any responsibility. It is not fair. With that being said, yes, you do have a right to be put back on the position you were before the accident!

You must be able to dispute the car of the vehicle by getting the proper actual cash value. Also you do have rights regarding your expenses (having to go back to get your stuff out).
