Auto Insurance Claims: UIM, underinsured motorist, wage statements

Question
Hello,

I have just opened un underinsured motorist claim with my insurance.I was involved in a pedestrian-auto accident. The at fault party has a low policy $25,000 and has offered me all of it.However $15,000 will go to my employer (i was hurt during my lunch break and they covered my medical expenses and temporay disability) and $10,000 will go to me.My lost wages are $29,000-$11,000 (temporay disability paid)= $18,000.The amount they are going to offer me doesn't cover my lost wages nor anything for pain and suffering. So I was advised to open a UIM claim with my insurance.
Any suggestions on how to handle my UIM claim with my insurance?
Will my insurance act on my intrest or theirs?
Can I also file a UIM claim with my employer's car insurance?

Thanks

Answer
Hi Dan,

You would handle the UIM claim just as if you were dealing with the other persons insurance company. Your insurance company will still try to minimize the claim. You will have to present the entire claim to your insurance company including all medical bills, lost wage statements, etc. You should make an initial demand of an amount of money that is 3 to 5 times the total of your medical bills pluss your lost wages. Then you will negotiate with your insurance company to reach a final settlement.

If at any time you do not feel you are being treated fairly, seek the advice of an attorney.

I hope this helps
