Auto Insurance Claims: How to request to access the fault?, auto insurance company, insurance record

Hi! My car was hit by the other vehicle that was backing up. The police report was the officer is unable to determine the fault. So I had to file the claim with my own insurance and got the check after the deductible about one and half year ago. But, my own insurance never accessed the fault. The insurance record was just “the other car backed up and hit.” I have already changed the insurance company. Can I still request my former auto insurance company to access the fault? I think I may collect at least 50% of my deductible even if the fault is 50/50, right? Please advise me how I request the determination of the fault?

Yes, you can still request that they determine liability.  They probably did but just did not discuss it with you.  They are required to determine liability in every accident claim.  If they believe you were not liable, they should file arbitration against the other party's insurance company and try to recover their payment as well as your deductible.
