Question
A tree branch fell on the hood of my truck and smashed the hood, it was parked at my home that I am renting.  First I would like to know should I contact my own insurance company and have them pay for the damages or should the renter be responsible for the damage?  Second can I file two claims one with the renter and the second with my insurance?

Hi Peggy,

You only have one claim here and it will be with your auto insurance company. Who ever owns the tree is not legally responsible for falling branches unless you can prove that the tree was dead or deseased and that the owner knew that and did nothing to remove the tree. Otherwise it is just something that happens.
