Auto Insurance Claims: Timeframe for CA insurance companies to do their job, claim time, insurance law

Question
I asked this question previously, and its apparent I may have said something that offended a current insurance agent, because I expressed the lack of service I was receiving from my insurance company. My question is simple. What is the reasonable time frame that a CA insurance company has to pay for the damages on a vehicle that was stolen, and has been recovered? My vehicle was stolen on DEC 1st, and recovered on December 3rd, today is the 2nd, and they have done the appraisal, sent me paperwork that they will be covering the claim. NO CHECK YET. So, to really break it down, how long, until an insurance company has to actually do their job! Should I expect my check in mid January, to pay my body shop for repairs? If so, what vehicle insurance law outlines the time frame for payment of a claim, time frame to get an adjuster to see your vehicle. I believe they should have some regulations, but not sure?

Answer
Hi Vanessa,

In most states an insurance company has 30 days to investigate and either pay or deny a claim. However, when the claim involves a theft, fire or vandalism, the time frame is increased to 60 days. This is due to the additional investigative steps that are taken.

In your case, the fact that you have already received written confirmation that they are covering the loss, they have inspected your car and it appears that you are only waiting for a check. You should simply call your adjuster and ask him/her when the check will be issued. If need be you can ask to speak to a supervisor or manager. Do not stop asking until you get an answer you are satisfied with.

I hope this helps
