Hey Richard,

I was recently involved in a parking lot accident and was wondering if you could help me out. Here's what happened:

It was a Wendy's parking lot. Cars were parked on both ends of it and the driveway was in da middle. I went in to look for parking and there was no parking. So I decided to reverse out of that particular area of the parking lot because it was a dead end and turning around was almost impossible with the space provided. While reversing I did not see any car behind me until a car immediately pulled out of its spot and the rear right side of my bumper hit the front right fender of her car. I'm not sure who is at fault here. From my knowledge when you are coming out of a parking spot you have to yield to the traffic in the driveway. According to the lady I hit, I backed into her car while she was about a quarter way out which is how I managed to hit the front fender just above the tire. She says it's my fault and I wouldn't know who's fault it was. So if you could please help me.

Hi Hamaad,

Parking lot accidents are some of the most difficult to determine who is at fault. Both drivers have a different story and vehicles in parking lots often do not do what they should. As a result, in most cases in a parking lot accident each driver will be found to be 50% at fault.
