Auto Insurance Claims: auto insurance lawsuit, insurance lawsuit, statute of limitations

Question
i had a accident in 2001 it was my fault. i got a phone call friday afternoon that the person that i hit was filing suit against me as far as i know no one was hurt and my insurance agent doesnt even have anything still in his computer about the accident my question is can someone still sue you after 7 1/2 years?

Answer
Hi Gina,

The statute of limitations is different in each state but generally runs from 2 years to 6 years from the date of the accident. You should contact the claims department of your insurance comapny to find out what the statute of limitations is in your state. If you receive law suit papers you should immediately call your insurance company to notify them. If it is beyond the statute of limitations, your insurance company will have an attorney answer the suit and have it thrown out of court. If you are still within the statute of limitations, your insurance company will provide you with an attorney to defend the suit.

I hope this helps
